Overview of Form 1099-MISC 2012
For 2012, Form 1099-MISC was used to report specific payment types, including rents, royalties, other income, medical or health care payments, fishing boat proceeds, and, when applicable, nonemployee compensation reported in Box 7.
Box 5 (Fishing Boat Proceeds) existed before 2012 and was not newly introduced that year. The
rules for backup withholding in 2012 are based on IRC §3406 and IRS guidelines for information returns, and they differ from FATCA (chapter 4), which is an international withholding tax.
Filing Steps Checklist
Step 1: Identify Reportable Income Categories for 2012
Review payments made during 2012 to determine which boxes apply. Box 1 (rents), Box 2
(royalties), Box 3 (other income), Box 4 (federal income tax withheld), and Box 5 (fishing boat proceeds) each have a specific definition in the 2012 instructions.
Box 6 (medical payments) and Box 7 (nonemployee compensation) have separate reporting rules and thresholds. Confirm the payment type before entering any amount.
Step 2: Apply Reporting Thresholds Correctly
Report nonemployee compensation (Box 7) if total payments equal $600 or more for the calendar year 2012. Many payments to corporations are exempt, but key exceptions apply, such as payments for legal services.
The $600 threshold applies to many, but not all, categories. Royalties generally have a $10 threshold. If backup withholding was withheld, an information return may be required even if payments are below the normal reporting threshold.
Step 3: Determine Backup Withholding Requirements Using 2012 Rules
Backup withholding applies at 28% if a payee fails to provide a TIN, improperly claims exemption, or the IRS notifies you of a TIN mismatch.
Backup withholding rules are governed by IRC §3406 and IRS information-return guidance. IRS
TIN Matching is a voluntary pre-filing tool that is not required before making payments.
Compliance is based on proper TIN solicitation and response to IRS notices.
Step 4: Report Fishing Boat Proceeds in Box 5 Accurately
Box 5 is used to report fishing boat proceeds as defined in the 2012 instructions. This includes an individual’s share of proceeds from the sale of a catch or the fair market value of in-kind distributions.
Certain catch-contingent cash payments of up to $100 per trip are also reportable. Reporting applies only when specific conditions are met, such as when a boat typically has fewer than 10 crew members, and compensation is based on the catch.
Step 5: Enter Federal Income Tax Withheld in Box 4
Box 4 reports any federal income tax withheld during 2012, including backup withholding. Do not include state or local withholding. Backup withholding reported in Box 4 is generally reconciled and reported on Form 945, not Form 941.
Step 6: Collect and Maintain Payee Identification Information
Request Form W-9 from payees as part of onboarding or before the first payment, consistent with IRS TIN solicitation rules. The payee provides their name and TIN and certifies accuracy under penalties of perjury.
IRS TIN Matching is optional and not required before payment. If a payee does not provide a
TIN, backup withholding generally applies. IRS guidance commonly recommends retaining
Forms W-9 for four years.
Step 7: Complete Recipient Information and Aggregate Annual Totals
Enter the recipient’s name, address, and TIN in the designated recipient information fields on
Form 1099-MISC. These details are not entered in Boxes 9 through 14. Aggregate all 2012 payments by payee and by box category. Use one Form 1099-MISC per payee to report all applicable box totals.

Step 8: Reconcile Records and File Forms by the Correct Deadlines
Match amounts reported on Form 1099-MISC to accounting records for 2012. Furnish the recipient with Copy B by January 31, 2013, unless an exception applies. File Copy A with the
IRS by February 28, 2013, if filing on paper, or April 1, 2013, if filing electronically. Extensions may be requested using Form 8809, subject to IRS rules.
