Form 7004 (Rev. November 2011) Checklist

Purpose

Form 7004 requests an automatic extension of filing time for business income tax returns, partnerships, trusts, and information returns. The November 2011 revision implemented significant changes following final regulations effective June 24, 2011, which modified extension periods for estates and trusts.

Completion Steps for 2011 Tax Year

Step 1: Select the Correct Form Code

Identify the appropriate form code from the 2011 Form 7004 revision:

Part I - Automatic 5½-Month Extension:

  • Code 08: Form 1041 (bankruptcy estate only)
  • Code 09: Form 1041 (estate other than a bankruptcy estate)

Part II - Automatic 6-Month Extension:

  • Code 25: Form 1041 (trust)

Note that bankruptcy estates filing after June 23, 2011, became eligible for a 6-month extension despite initially appearing in Part I with code 08.

Step 2: Verify Taxpayer Information

Confirm that the taxpayer’s legal name and Employer Identification Number (EIN) exactly match the return for which the extension is requested. Any name mismatch between Form 7004 and the underlying return may cause processing delays.

Step 3: Enter Complete Mailing Address

Use United States Postal Service format for domestic addresses. For foreign addresses, enter the city, province or state, and country following that country’s postal code convention. Do not abbreviate the country name.

Step 4: Identify the Tax Year

Specify whether the tax year is a calendar year or fiscal year by entering the beginning and ending dates. If the tax year is short (less than 12 months), check the applicable reason: initial return, final return, change in accounting period, or consolidated return to be filed.

Step 5: Calculate Tentative Total Tax

Enter the tentative total tax for the 2011 tax year on line 6. Include all income tax, alternative minimum tax, and any other tax liabilities applicable to the entity type identified by the form code selected in Step 1. Enter zero if no tax is expected.

Step 6: Report Total Payments and Credits

On line 7, report all payments and credits, including estimated tax payments made during 2011, withholding payments, and any allowable credits. Overpayments from prior years applied to the 2011 tax liability count as credits.

Step 7: Determine Balance Due

Subtract line 7 from line 6 to calculate the balance due on line 8. The extension application must be submitted by the original return due date regardless of whether the balance is zero, positive, or negative. A negative balance (overpayment) does not affect extension approval.

Step 8: Complete Consolidated Return Requirements

If filing as a corporate common parent requesting a consolidated return extension, attach a schedule listing the name, address, and EIN for each subsidiary member. This attachment is mandatory under the 2011 revision for consolidated filers.

Step 9: File by the Original Due Date

Submit Form 7004 on or before the original due date of the return. Extensions are automatic upon proper filing—no IRS approval notification will be sent unless the request is disallowed.

Step 10: Make Required Tax Payment

Form 7004 extends only the filing deadline, not the payment deadline. Pay any balance due shown on line 8 by the original return due date to avoid penalties and interest. Use electronic funds transfer (EFTPS) as required beginning January 2011.

Year-Specific 2011 Updates

Bankruptcy Estate Extension Change

Beginning June 24, 2011, bankruptcy estates filing Chapter 7 or Chapter 11 returns became eligible for an automatic 6-month extension instead of the previous 5½-month extension. This change resulted from final regulations published in the Federal Register on June 24, 2011, which aimed to reduce taxpayer burden and provide reasonable extension periods for pass-through entities.

Extension Period Clarification

Part I of Form 7004 provides an automatic 5½-month extension (not simply 5 months) for non-bankruptcy estates. Part II provides an automatic 6-month extension for trusts. The actual extension periods are critical for calculating proper due dates.

Electing Small Business Trusts and Qualified Funeral Trusts

Form 1041-N (Electing Small Business Trust) and Form 1041-QFT (Qualified Funeral Trust) filers may request extensions using the appropriate codes in Part II, receiving 6-month automatic extensions under 2011 rules.

Foreign Address Requirements

Foreign corporations and entities must enter addresses following each country’s postal code practice. Include the city, province or state, and country in the proper order without abbreviating the country name. This represents updated guidance from prior years.

Electronic Filing and Payment

Form 7004 can be filed electronically for most returns through approved IRS e-file providers. However, electronic filing is not available for Forms 8612, 8613, 8725, 8831, 8876, or 706-GS(D). Electronic funds transfer became mandatory for federal tax deposits beginning January 1, 2011.

Important Reminders

No Blanket Extensions

File a separate Form 7004 for each return requiring an extension. Each extension applies only to the specific return identified on line 1a or line 1b. Do not complete both Part I and Part II on the same form.

Automatic Approval

Properly filed extension requests are automatically granted. The IRS will notify you only if your extension request is disallowed. No signature is required on Form 7004.

Penalties Still Apply

Late payment penalties of ½ of 1% per month apply to unpaid tax even with a valid extension. Late filing penalties apply if returns are not filed by the extended deadline. Interest accrues on unpaid tax from the original due date until paid.

Corporate Safe Harbor

Corporations granted an extension avoid late payment penalties if the tax shown on line 6 (or paid by the regular due date) equals at least 90% of the actual tax liability, and the balance is paid by the extended due date.

Special Circumstances

Certain foreign corporations without a U.S. office or place of business, domestic corporations with books and records outside the U.S., and certain partnerships with foreign books qualify for additional extension provisions under Regulations section 1.6081-5. Check box 4 on Form 7004 if requesting additional extension time under these provisions.

Qualified Revocable Trusts

Qualified revocable trusts (QRTs) making section 645 elections to be treated as part of a related estate must obtain new taxpayer identification numbers following the decedent’s death, regardless of whether the election is made. Follow special filing procedures outlined in Regulations section 1.645-1.

Where to File

File paper Forms 7004 at the appropriate IRS Service Center based on the form type and principal business location. For Form 1041, estates and trusts in eastern states file with Cincinnati, OH 45999-0045, while western states file with Ogden, UT 84201-0045. Electronic filing addresses are handled automatically through e-file providers.
