Form 1096 (2022) Checklist
Purpose
Form 1096 transmits paper information returns (Forms 1097, 1098, 1099, 3921, 3922, 5498, W-2G) to the IRS. For the 2022 tax year, the 250-return electronic filing threshold remains in effect. The Taxpayer First Act authorized a reduction of this threshold for future years; however, regulations were not finalized by the 2022 filing deadline, and the threshold remained at 250 returns of any one type (excluding Form 1098-F).
Filing Steps
Step 1: Verify Filer Information Accuracy
Ensure your filer name and TIN match exactly across all accompanying information returns (1097, 1098, 1099, 3921, 3922, 5498, and W-2G). This consistency prevents penalties for 2022 information returns. Never use your paying agent’s or service bureau’s TIN or name—only use your own business identification.
Step 2: Determine Electronic Filing Requirements
Count your total information returns of each type for the 2022 tax year. If any single form type reaches 250 or more returns (excluding Form 1098-F), electronic filing is mandatory unless you have an approved waiver. Paper filing is prohibited when you exceed this threshold. Forms 1099-QA and 5498-QA are exceptions and can be filed on paper regardless of volume.
Step 3: Enter Your Taxpayer Identification Number
Enter your TIN in either box 1 (EIN) or box 2 (SSN), not both. Sole proprietors and all business entities must use their EIN in box 1. However, sole proprietors without an EIN may enter their SSN in box 2. Individuals not in trade or business must enter their SSN in box 2.
Step 4: Count Forms Correctly
In box 3, enter only the number of correctly completed forms you are transmitting. Exclude blank forms, voided forms, and the Form 1096 itself from your count. If using forms printed three to a page, count individual completed forms, not pages. For example, two completed forms on one three-per-page sheet equals “2” in box 3.
Step 5: Confirm Filing Deadlines by Form Type
Different forms have different filing deadlines for the 2022 tax year. Forms 1097, 1098, 1099 (except 1099-NEC), 3921, 3922, and W-2G must be filed by February 28, 2023 (paper) or March 31, 2023 (electronic). Form 1099-NEC requires filing by January 31, 2023, for both paper and electronic submissions. Forms 5498, 5498-ESA, 5498-QA, and 5498-SA are due May 31, 2023.
Step 6: Group Forms by Type
Submit one Form 1096 per form type. For example, prepare separate transmittals for Forms 1098 and 1099-A even if filing both. Do not include summary or subtotal forms with your transmittal. You may combine original and corrected returns of the same type on one Form 1096, but separate different form types.
Step 7: Calculate Box 5 Totals Accurately
Box 5 requires specific amounts based on form type. For Form 1099-NEC, report box 1. For Form 1099-DIV, include boxes 1a, 2a, 3, 9, 10, and 12. For Form 5498, sum boxes 1, 2, 3, 4, 5 (fair market value), 8, 9, 10, 12b (required minimum distribution amount), 13a (postponed contributions), and 14a (repayments). Each form type has unique box combinations detailed in the official instructions.
Step 8: Select the Correct Mailing Address
Choose your mailing address based on your principal business location, office, or legal residence. For 2022, use the Austin, TX address if located in the Southern states or overseas. Use Kansas City, MO, as a representative for the Midwestern and Western states. Use Ogden, UT, for the Northeastern and Mid-Atlantic states. All overseas filers must use the Austin, TX address regardless of business location.
Step 9: Sign and Date Under Penalties of Perjury
The form requires an authorized signature certifying that you have examined the return and accompanying documents. Include your title along with the signature and date. This certification is made under penalties of perjury, confirming that all information is true, correct, and complete to the best of your knowledge.
Step 10: Use Official Scannable Forms
Order official pre-printed forms directly from the IRS. Downloaded and printed copies from the IRS website are not scannable and will result in penalties for filing non-scannable submissions. The IRS processing system requires specific red ink formulations found only on official forms. Contact the IRS at 1-800-TAX-FORM or visit IRS.gov/orderforms to request official forms.
Step 11: Prepare Forms for Mailing
Do not staple Form 1096 to the accompanying information returns. Mail all documents in a flat mailer without folding. Folded or stapled forms may cause scanning errors, resulting in processing delays and potential penalties for non-scannable submissions. Ensure all forms remain flat and undamaged during transit.
Step 12: Verify Cross-References with Employment Tax Returns
Your filer name and TIN on Form 1096 must match the name and TIN used on your 94X series employment tax returns. Mismatches between information returns and employment tax returns create penalty exposure for the 2022 tax year. Review your quarterly employment tax filings to confirm consistency across all federal tax documents.
Step 13: Confirm Extension Requests if Needed
If you are unable to meet the filing deadline, please submit Form 8809 to request an automatic 30-day extension. File the extension request by the original due date of the returns. Under certain hardship conditions, you may apply for an additional 30-day extension. Please note that no automatic extension is available for Forms W-2 and 1099-NEC, as these forms require special consideration.
Step 14: Review Final Submission Before Mailing
Conduct a final quality check before mailing. Verify that box 6 indicates only one form type, box 3 count matches your actual form submissions, box 4 shows correct federal income tax withheld totals, and box 5 calculations follow the specific requirements for your form type. Confirm your mailing address corresponds to your geographic location.
Step 15: Keep Documentation Records
Retain copies of Form 1096 and all transmitted information returns for your records. These documents support your information reporting compliance and provide a reference for future corrections or IRS inquiries. Maintain organized files by tax year and form type for efficient retrieval of records.

The Taxpayer First Act of 2019 authorized the IRS to reduce the 250-return electronic filing threshold for 2022 and subsequent tax years. However, final regulations were not issued before the 2022 filing deadline, so the 250-return threshold remained in effect for 2022 tax year filings due in 2023.
Forms 1099-QA and 5498-QA are designated as paper-only filings regardless of volume. All other form types are subject to the 250-return electronic filing mandate when the threshold is met.
Filer name and TIN mismatches between Form 1096 and corresponding 94X series employment tax returns create information return penalty exposure for 2022. Filers must cross-verify TIN and name consistency on all accompanying information returns before submission.

While Form 1096 is used only for paper submissions, the IRS strongly encourages electronic filing through the FIRE System (Filing Information Returns Electronically). Electronic filing eliminates the need for Form 1096 transmittals, reduces processing errors, and provides faster confirmation of receipt. The IRS developed IRIS (Information Reporting Intake System) as an online portal that allows taxpayers to file information returns for tax years 2022 and later electronically.
