What This Form Accomplishes
Individuals, estates, and trusts use Form 1045 to apply for an expedited tax refund when carrying back a 2016 net operating loss, unused general business credit, or net section 1256 contracts loss to earlier tax years. The 2016 version reflects updated treatment of the health care individual responsibility payment within tax decrease calculations, addressing ACA compliance obligations that remain in effect for the 2016 tax year.
Eligibility and Filing Requirements
Only individuals, estates, or trusts may file Form 1045 for tax year 2016. Partnerships, S corporations, and C corporations are ineligible to use this form. You must file Form 1045 within one year after the end of the year in which an NOL, unused credit, net section 1256 contracts loss, or claim of right adjustment arose. Confirm no Tax Court petition exists for the carryback years by completing line 7.
Preparation Steps
Schedule A — NOL Computation
Complete Schedule A if you are carrying back an NOL from 2016. Line 23 requires entry of the domestic production activities deduction from 2016 Form 1040 line 35, or Form 1040NR line 34, or Form 1041 line 15a for estates and trusts. On Schedule A line 16, identify any capital loss carryover from the 2016 Schedule D, distinguishing between long-term and short-term losses. The 2016 instructions specify separate line references for Schedule D (Form 1041) carryovers for estates and trusts at line 19, column (3).
Health Care Individual Responsibility Payment
Report the health care individual responsibility amount on Form 1045, page 2, line 28. Include any shared responsibility payment owed on the original 2016 return. The 2016 instructions clarify that this amount is part of the total tax for purposes of computing the decrease in tax under Section 1045(c).
Schedule B — Carryback Year Recalculations
For each carryback year on page 3, Schedule B, recalculate the prior year's taxable income by reducing it by the NOL carryback amount. Deduct any applicable net capital loss limitation, Section 1202 exclusion, and domestic production activities deduction claimed in that prior year.
Complete Schedule B lines 11–38 (Adjustment to Itemized Deductions) only if you itemized deductions in a carryback year and any of the following exceed zero:
- Net capital loss deduction on line 3
- Section 1202 exclusion on line 4
- Domestic production activities deduction on line 5
The 2016 instructions require separate referencing of prior-year Schedule A line numbers, which vary by carryback year.
Itemized Deduction Thresholds
On Schedule B line 30, apply the 10 percent threshold percentage to the modified adjusted gross income to compute the floor for casualty and theft loss deduction reduction. Line 35 applies the 2 percent threshold for miscellaneous itemized deductions, unchanged from 2015. These thresholds remain consistent with the 2016 Form 4684 instructions and prior-year standards.
Signature and Submission
Sign and date Form 1045 on page 2 in the “Sign Here” section. If you file jointly, both spouses must sign. Attach completed Schedule A and Schedule B, plus Schedule C if claiming an overpayment due to a claim of right adjustment under Section 1341(b)(1) at line 33. Mail the entire application in a separate envelope and do not attach it to your income tax return.
Critical 2016 Tax Provisions
Domestic Production Activities Deduction
- The domestic production activities deduction remains eligible for 2016 carrybacks on Schedule A line 23 and Schedule B line 5.
- This deduction is permanently eliminated for tax years beginning after December 31, 2017.
- Tax year 2017 was the final year to claim this benefit, with 2016 representing the penultimate year of availability.
Health Care Individual Responsibility Payment
- You must include the health care individual responsibility payment on Form 1045, page 2, line 28, in the total tax computation for the decrease-in-tax calculation.
- The 2016 instructions reaffirm that this penalty applies to tax years 2014 through 2018 and is factored into the Form 1045 refund analysis.
- The Tax Cuts and Jobs Act reduced the penalty to zero for tax year 2019 and all subsequent years.
NOL Carryforward Period
- Schedule A line 24 permits carryforward of NOLs generated before 2016 that were not yet used.
- The 2016 instructions establish a 20-year carryforward period for NOLs not fully absorbed in carryback years.
- This 20-year limit applies under pre-TCJA law to all NOL categories, including general NOLs, eligible losses, farming losses, qualified disaster losses, and specified liability losses.
Medical Expenses and Mortgage Insurance Adjustments
- Schedule B lines 14 through 21 reference specific 2016 Schedule A line numbers.
- These lines require comparison with threshold percentages stated in prior-year Schedule A instructions.
- You must cross-reference the correct prior-year form version to complete these adjustments accurately.
Reportable Transaction Disclosure
Line 8 requires disclosure of any part of the tax decrease arising from a reportable transaction under Section 6011. Filers must attach Form 8886 if the loss or credit qualifies. The 2016 instructions emphasize that this requirement applies to NOL and credit carrybacks without modification from prior years.
What To Attach
Attach the following items to Form 1045 for the year of the loss or credit:
- You must include pages 1 and 2 of your 2016 Form 1040 and Schedules A, D, and J (Form 1040), if applicable.
- Include any Form 4952, Investment Interest Expense Deduction, from your 2016 income tax return.
- The application requires all Schedules K-1 received from partnerships, S corporations, estates, or trusts that contribute to the carryback.
- Submit any application for extension of time you filed for your 2016 income tax return.
- You must include all Forms 8886, Reportable Transaction Disclosure Statement, filed with your 2016 income tax return.
- Include Forms 8302, Electronic Deposit of Tax Refund of $1 Million or More.
- Provide your Alternative Minimum Tax Net Operating Loss or Alternative Tax Net Operating Loss Deduction calculation.
- Submit Form 6251, Alternative Minimum Tax—Individuals, for each loss year.
- Include any detailed allocation schedules for a filing status change or for different spouses between the gain and loss years.
- The application requires any applicable election statement you filed.
- You must include all other forms and schedules from which a carryback results, such as Schedule C or F (Form 1040), Form 3800, Form 6478, Form 6781, or Form 3468.
