Income code 42 applies to earnings as an artist or athlete with no central withholding agreement, while income code 43 applies when a central withholding agreement exists.
Chapter Indicator and Exemption Codes
Determine the Chapter indicator by entering either 3 or 4 in Box 3, then confirm that the exemption codes align with 2024 FATCA status classifications. Common exemption codes include 13 for grandfathered payments, 14 for effectively connected income, 15 for payments not subject to Chapter 4, and 19 for payments exempt under an intergovernmental agreement.
Chapter 3 Status Code Assignment
Identify Chapter 3 status codes for the withholding agent in Box 12b, recipient in Box 13f, intermediary in Box 15b, and payer in Box 16d using 2024 codes 05 through 39. Territory FI categories use specific codes 03, 04, 10, and 11, with codes 04 and 10 identifying Territory FIs treated as U.S. persons and codes 03 and 11 identifying Territory FIs not treated as U.S. persons.
Chapter 4 Status Code Selection
Select Chapter 4 status codes in Boxes 12c, 13g, 15c, and 16e from 2024 codes 01 through 50 and pooled codes 42 through 49. Confirm use of code 38 for U.S. branches with ECI presumption applied and code 50 for foreign branches of financial institutions only when these classifications apply to the specific payment.
Limitation on Benefits (LOB) Codes
Complete Box 13j with the LOB code when treaty benefits are claimed by an entity recipient, selecting from codes 02 through 12. Available codes include:
- Code 02 for government entities
- Code 03 for tax-exempt pension trusts
- Code 04 for charitable organizations
- Code 05 for publicly traded corporations
- Code 06 for subsidiaries of publicly traded corporations
- Code 07 for companies meeting ownership and base erosion tests
- Code 08 for companies meeting the derivative benefits tests
- Code 09 for companies with income meeting active trade or business tests
- Code 10 for discretionary determinations
- Code 11 for other categories
- Code 12 indicates that no LOB article exists in the treaty.
Withholding Reporting and Timing Flags
Report withholding in Box 7a, then check Box 7b only if federal tax was held in escrow per adjustment procedures under Regulations sections 1.1471-2(a)(5)(ii) or 1.1441-3(d). Check Box 7c if you are a partnership that withheld on a foreign partner's share after March 15 of the subsequent year for income received in the 2024 calendar year. Total Withholding Credit Calculation

Payer, Intermediary, and Flow-Through Entity Documentation
Document payer information in Boxes 16a through 16e and intermediary or flow-through entity information in Boxes 15a through 15i with GIIN and country code when required. Enter the GIIN if the entity qualifies as a participating FFI or registered deemed-compliant FFI under the 2024 FATCA definitions. Country codes must follow the two-letter ISO format as specified in the IRS country code list.
Recipient Account and Identification Requirements
Record the recipient's date of birth in Box 13l using YYYYMMDD format when this information is required for the payment. Enter the account number in Box 13k to support dormant account escrow procedure compliance and IGA reporting requirements for 2024. U.S. financial institutions or U.S. branches maintaining accounts within the United States must report payments on a separate Form 1042-S for each financial account.
Copy Distribution and Filing
Provide appropriate copies to the required parties:
- Copy A is filed with the IRS.
- Copy B is provided to the recipient for their records.
- Copy C is provided to the recipient to attach to their federal tax return.
- Copy D is provided to the recipient to attach to their state tax return.

2024 Year-Specific Updates
Territory FI Classification Expanded
Code references now distinguish Territory FIs treated as U.S. persons from those not treated as U.S. persons. Codes 04 and 10 identify Territory FIs treated as U.S. persons for Chapter 3, while code 04 applies for Chapter 4. Codes 03 and 11 identify Territory FIs not treated as U.S. persons for Chapter 3, while code 03 applies for Chapter 4.
Dormant Account Escrow Procedure Formalized
Box 7b checking is permitted only if escrow procedures are applied per Regulations section 1.1471-4(b)(6) for Chapter 4 purposes. This escrow treatment differs from Chapter 3 escrow procedures and applies specifically to dormant accounts. Exemption code 20 identifies payments allocable to dormant accounts under participating FFI or registered deemed-compliant FFI withholding statements.
Artist and Athlete Central Withholding Agreement Reporting
Income codes 42 and 43 require the corresponding recipient status code 22 for artist or athlete classification. Code 43 is limited to cases where Letter 4492, the Venue Notification, has been issued by the IRS. If no Letter 4492 has been issued, withholding agents must use income code 42 instead, and compensation that would otherwise fall under codes 17 through 20 must be reported using the artist or athlete codes when directly attributable to the recipient's occupation.
IGA Exempt Account Treatment
Exemption code 19 applies to payments exempt from withholding under an intergovernmental agreement. This code applies to U.S. reportable accounts designated by code 33 and nonconsenting U.S. accounts designated by code 34 under Chapter 4 pooled reporting. Withholding agents must verify the applicable IGA provisions before applying this exemption code.
Partnership Interest Deferred Withholding Flag
Box 7c indicates withholding occurred in a year after the receipt of partnership interest income. This differs from contemporaneous withholding reported in Box 7a and applies when a partnership withholds on amounts includible in a foreign partner's share after March 15 of the subsequent year. Partnerships using this reporting have an extended due date of September 15 to file and furnish the Form 1042-S for the preceding year.
