Answer all questions on Schedule OI regarding visa type on the last day of 2015, days present in the United States during 2015, 2014, and 2013, and citizenship and tax residence country. Determining your filing requirement is the foundational step before beginning any tax preparation activities.

Step 2: Gather and Attach Wage and Income Documentation

Collect all Forms W-2 documenting wages, salaries, and tips, Forms 1042-S showing U.S. source income with withholding, Forms SSA-1042S or RRB-1042S reporting Social Security or railroad retirement benefits, Forms 8288-A documenting real property withholding, and Forms 1099-R showing IRA and pension distributions with withholding.

Staple all wage documents to the left margin of Form 1040NR page 1, in the order specified in the instructions. If 2015 marketplace health insurance coverage involved advance premium tax credit payments, obtain Form 1095-A from the Marketplace showing enrollment premiums and advance premium tax credit amounts paid on your behalf.

Step 3: Report Effectively Connected Income on Page 1, Lines 8 Through 23

Enter wages on line 8, reporting only U.S. source wages; taxable interest on line 9a; ordinary dividends on line 10a; taxable refunds, credits, or offsets of state and local income taxes on line 11; alimony received on line 12; business income or loss on line 13, attaching Schedule C; capital gains or losses on line 14, attaching Schedule D if required; taxable income from estates and trusts on line 15; farm income or loss on line 16, attaching Schedule F; rental real estate, royalty, partnership, S corporation, estate, and trust income on line 18, attaching Schedule E; and qualified dividends on line 20, reporting the amount here rather than on line 10a.

Combine all effectively connected income amounts on line 23 to determine the total income effectively connected with U.S. trade or business.

Step 4: Calculate Adjusted Gross Income, Lines 24 Through 36

Enter educator expenses on line 24; health savings account deduction on line 25, available only if self-employed or not covered by employer high-deductible health plan; moving expenses on line 26; deductible part of self-employment tax on line 27; self-employed SEP, SIMPLE, and qualified plan contributions on line 28; self-employed health insurance deduction on line 29; penalty on early withdrawal of savings on line 30; scholarship and fellowship grant exclusions on line 31.

Enter IRA deduction on line 32, student loan interest deduction on line 33, subject to income limitations, and domestic production activities deduction on line 34. Combine all deductions on line 35 and subtract from line 23 to calculate adjusted gross income on line 36.

Step 5: Complete Schedule NEC for Non-Effectively Connected Income

If you received any non-effectively connected income, including dividends, interest, royalties, pensions, annuities, or fixed gains and losses not connected to U.S. business activities, report on Schedule NEC lines 1a through 12 in the appropriate tax rate column: (a) 10%, (b) 15%, (c) 30%, or (d) other treaty rate.

Enter the nature of income and amount in each column. Sum all income on line 13, multiply by the rate at the top of each column on line 14, and total tax on line 15. Enter this total tax on Form 1040NR line 54. Non-effectively connected income is taxed at flat rates rather than graduated rates, requiring separate calculation and reporting.

Step 6: Calculate Itemized Deductions and Taxable Income, Lines 37 Through 41

If your adjusted gross income on line 36 exceeds the threshold for your filing status of $309,900 for box 6, qualifying widow or widower; $258,250 for boxes 1 or 2 single filers, or $154,950 for boxes 3, 4, or 5, married filers, itemized deductions may be limited.

Complete Schedule A for Form 1040NR only; do not use Schedule A for Form 1040 with Form 1040NR, as they are different schedules with different allowable deductions. Enter total itemized deductions on Form 1040NR line 38.

Do not use the standard deduction, as nonresident aliens cannot claim the standard deduction. Subtract line 38 from line 37 to calculate income after itemized deductions, then subtract personal exemptions to arrive at taxable income on line 41.

Step 7: Compute Tax, Credits, and Premium Tax Credit Reconciliation

Calculate tax on line 42 using the appropriate 2015 tax table or worksheet for your filing status, as tax rates vary by income level for nonresidents. Add alternative minimum tax on line 43 if applicable, attaching Form 6251.

Reconcile any 2015 advance premium tax credit payments: obtain Form 1095-A from the Marketplace, complete Form 8962 to calculate your actual premium tax credit, and enter the net premium tax credit or repayment on line 65.

Claim only credits applicable to nonresident aliens: foreign tax credit on line 46, child and dependent care credit on line 47, education credits on line 48 if eligible, retirement savings contribution credit on line 50, and residential energy credits on line 51.

Nonresident aliens cannot claim earned income credit, credit for the elderly or disabled, or American Opportunity credit unless they elect to be taxed as resident aliens for the entire year.

Step 8: Calculate Total Tax Liability, Lines 43 Through 61

Add lines 42, 43, and any excess advance premium tax credit repayment on line 44 to compute tax before credits on line 45. Subtract total credits on line 52 from line 45 to get tax after credits on line 53.

Add tax on non-effectively connected income from line 54, self-employment tax on line 55 if net earnings from self-employment exceed $400 and you are a resident of a country with a U.S. social security agreement, an alternative tax on qualified retirement plans on line 57, and any write-in taxes on line 60. To determine your complete tax liability for the year, total all taxes on line 61. This comprehensive calculation guarantees the accurate inclusion of all tax categories.

Step 9: Report Payments, Withholding, and Net Premium Tax Credit

Enter federal income tax withheld from wages shown in box 2 of Form W-2 on line 62a. Enter withheld tax from Form 1042-S on line 62b. Report estimated tax payments made during 2015 on line 63 and any additional child tax credits, if eligible, on line 64.

On line 65, enter the net premium tax credit from Form 8962 if you reconciled the advance premium tax credit; this may be a credit that reduces tax owed or a repayment amount that increases tax owed.

Report payments made with a Form 2688 extension request on line 66 and excess social security or tier 1 railroad retirement tax withheld on line 67. Total all payments on line 71 to determine your total tax payments for comparison against the total tax liability.

Step 10: Complete Schedule OI, Sign, Date, and Submit

Answer all questions on Schedule OI: country or countries of citizenship on Item A, country of tax residence during 2015 on Item B, green card application status on Item C, prior U.S. citizenship or green card status on Item D, visa type or immigration status on last day of 2015 on Item E, visa or status changes during 2015 on Item F, entry and exit dates on Item G, number of days present in United States in 2013, 2014, and 2015 on Item H, and prior tax return filing history on Item I.

Item L, not Item J, contains the Income Exempt from Tax section where treaty benefits are disclosed on Schedule OI for Form 1040NR. If claiming treaty benefits, complete Item L with the country name, applicable treaty article, number of months benefits claimed in prior years, and amount of exempt income in 2015; attach Form 8833 if required.

Sign and date Form 1040NR under penalty of perjury. If married and filing jointly as nonresidents, both spouses must sign, which is only allowed if they have elected to be taxed as residents and the spouse is a U.S. citizen or resident at the end of the year.

Attach all supporting schedules and documents in order; reference the IRS Where to File page for Form 1040NR 2015 to determine the correct mailing address for your situation.

Form-Specific Restrictions and Required Attachments

Nonresident alien filers cannot claim the standard deduction and must itemize deductions on Schedule A for Form 1040NR only. Cannot file as a head of household filing status. Cannot claim earned income credit, credit for the elderly or disabled, or American Opportunity education credit unless electing to be taxed as a resident alien for the entire year.

If you are married and your spouse is a nonresident alien at any time during 2015, you cannot file a joint return unless your spouse elects to be treated as a resident. You cannot claim exemptions for your spouse or dependents to reduce your taxable income below zero. Dependents must be U.S. citizens, nationals, or residents to qualify for the child tax credit.

Required schedules and forms include Schedule A for Form 1040NR for itemized deductions if claiming any deductions, Schedule NEC for Form 1040NR if reporting non-effectively connected income, including dividends, interest, royalties, pensions, annuities, or other fixed or determinable income, and Schedule OI for Form 1040NR, which must be completed and attached with all questions answered as mandatory.

Form 8833 for Treaty-Based Return Position Disclosure if claiming treaty benefits that reduce tax, unless the exception applies for payments under $10,000. Form 8962 for the Premium Tax Credit if an advance premium tax credit was paid for 2015 marketplace coverage. Form 8843 Statement for Exempt Individuals if claiming exclusion of days as a student, teacher, trainee, or professional athlete. Form 8840, the Closer Connection Exception, is required if you are claiming a closer connection to a foreign country to remain a nonresident despite meeting the substantial presence test.

Supporting schedules include Schedule C for Form 1040, which reports business income; Schedule D for Form 1040, which reports capital gains; Schedule E for Form 1040, which reports rental and partnership income; and Schedule F for Form 1040, which reports farm income. All Forms W-2, 1042-S, and other income documents must be attached.

Schedule and Line Changes for Form 1040NR, Tax Year 2015

Schedule OI's mandatory completion requirement was clarified for 2015. The 2015 Instructions emphasize that all questions on Schedule OI must be answered, even those deemed not applicable. The present represents a clarification from prior guidance that treated some items as conditional.

Item L for treaty benefits disclosure on Schedule OI requires entry of country name, applicable treaty article, number of months treaty benefits were claimed in prior tax years, and amount of exempt income in current tax year, with Form 8833 required if benefits reduce tax unless an exception applies for payments totaling $10,000 or less. This clarification ensures proper disclosure of treaty-based positions.

Line 65 for the Premium Tax Credit, net or repayment, was added for 2015. In prior years, Form 1040NR did not require reconciliation of advance premium tax credits from the marketplace. The 2015 form introduced line 65 to report the net premium tax credit from Form 8962. If the advance premium tax credit exceeded the earned credit, line 65 represents a repayment subtracted from payments. If the earned credit exceeded the advance premium tax credit, line 65 represents a credit added to reduce the tax. This addition reflects the implementation of Affordable Care Act provisions requiring the reconciliation of advance payments.
