Form 1040-ES(NR): 2020 Estimated Tax Guide for Nonresident Aliens

Overview

Form 1040-ES(NR) enables nonresident aliens to calculate and remit quarterly estimated tax payments on income not subject to withholding for 2020. This form is for nonresident alien individuals, estates, and trusts that earn U.S. source income or income effectively connected with a U.S. trade or business. Nonresident aliens cannot file joint estimated tax payments with a nonresident alien spouse.

2020 Key Provisions

Social Security wage base: $137,700. Self-employment tax: 15.3% on 92.35% of net income. Additional Medicare tax: 0.9% on wages exceeding $200,000 single or $250,000 married filing jointly. Net investment income tax: 3.8% when modified AGI exceeds these thresholds. Personal exemptions: suspended at zero. Tax rates on effectively connected income range from 10% to 37%. Non-effectively connected income: flat 30% or lower treaty rate.

Understanding Nonresident Status

Nonresident aliens fail to meet either the green card test or the substantial presence test. The substantial presence test requires at least 31 days in the U.S. during 2020, plus 183 days over three years: 100% of the 2020 days, 33% of the 2019 days, and 17% of the 2018 days. Exempt individuals include foreign government officials, teachers, trainees, and students on qualifying visas.

Income Classification

Effectively connected income is taxed at graduated rates from 10% to 37%, after deductions. This includes U.S. business profits, inventory sales, rental property if elected, U.S. real property gains, scholarships for services, and partnership income from U.S. businesses. Non-effectively connected income is subject to a flat 30% rate or a lower treaty rate, with no deductions. This includes passive interest, dividends, rental income, and gambling winnings.

Step-by-Step Filing Process

Step 1: Determine Payment Requirement

You must make estimated tax payments if you expect to owe at least $1,000 after subtracting withholding and credits, and your withholding and credits will be less than the smaller of 90% of your 2020 tax or 100% of your 2019 tax. You are exempt if you were a nonresident alien for all of 2019 with zero tax liability.

Step 2: Apply Higher Income Rules

If the 2019 adjusted gross income exceeded $150,000, or $75,000 if the filing status for 2020 is married filing separately, use 110% of the 2019 tax instead of 100% when calculating required payments. This rule does not apply to farmers or fishermen.

Step 3: Check Farmer and Fisherman Status

You qualify if at least two-thirds of your 2019 or 2020 gross income came from farming or fishing. Use 67% instead of 90% when calculating required payments. You can pay all estimated tax by January 15, 2021, if you file Form 1040-NR by March 1, 2021.

Step 4: Calculate Expected Income

Enter the expected 2020 adjusted gross income on line 1. Include wages, business income, capital gains, rental income, farm income, partnership distributions, and other taxable income effectively connected with a U.S. business. Exclude foreign source income that is not effectively connected with a U.S. business.

Step 5: Calculate Deductions

Enter itemized deductions on line 2a. Nonresident aliens generally must itemize their deductions and cannot claim the standard deduction, except for Indian students and business apprentices who are eligible under the U.S.-India treaty. Enter the section 199A qualified business income deduction on line 2b if applicable. Subtract lines 2a and 2b from line 1.

Step 6: Calculate Self-Employment Tax

If you have self-employment income, multiply net income by 92.35%. The 2020 Social Security wage base is $137,700. Apply 12.4% Social Security tax up to this limit and 2.9% Medicare tax on all earnings. Total rate is 15.3%. Multiply the total self-employment tax by 50% for the deductible portion. Church employees receiving $108.28 or more from exempt employers must pay self-employment tax on those wages.

Step 7: Calculate Tax

Calculate tax using 2020 Schedule X (Single): 10% on $0-$9,875; 12% on $9,875-$40,125; 22% on $40,125-$85,525; 24% on $85,525-$163,300; 32% on $163,300-$207,350; 35% on $207,350-$518,400; 37% over $518,400. Add the alternative minimum tax from Form 6251, if applicable. Add self-employment tax and other taxes, including additional Medicare tax and net investment income tax.

Step 8: Subtract Credits

Subtract allowable credits, including foreign tax credit, child tax credit if eligible as a resident of Canada, Mexico, or South Korea, and other applicable nonrefundable credits. Nonresident aliens face significant restrictions on available credits.

Step 9: Calculate Tax on Non-Effectively Connected Income

The expected 2020 income is not effectively connected with U.S. trade or business. Multiply by 30% or the applicable tax treaty rate, if appropriate. Add to tax on effectively connected income. Subtract refundable credits, including additional child tax credit, fuel tax credit, net premium tax credit, and health coverage credit if eligible.

Step 10: Determine Required Annual Payment

Multiply the total estimated tax by 90% (67% for farmers and fishermen). Calculate 100% of 2019 tax, or 110% if 2019 AGI exceeded $150,000 or $75,000 for married filing separately. Enter the smaller amount as your required annual payment.

Step 11: Calculate Net Required Payment

Subtract expected withholding from wages, pensions, and other income. Subtract estimated tax payments already made and the 2019 overpayment credited to 2020. If the result is less than $1,000, no estimated tax payment is required.

Step 12: Calculate Quarterly Installments

If you have wage withholding, divide by four for each quarterly payment. If no withholding and the first payment is due June 15, pay one-half on June 15, one-quarter on September 15, and one-quarter on January 15. Reduce each installment by the appropriate portion of withholding and credits.

Step 13: Make Payments on Due Dates

April 15, 2020: first income payment January 1-March 31. June 15, 2020: second payment for income April 1-May 31. September 15, 2020: third payment for income June 1-August 31. January 15, 2021: fourth payment for income from September 1 to December 31. Skip the January 15 payment if you file Form 1040-NR by February 1, 2021, and pay all tax due.

Step 14: Complete Payment Vouchers

Use the vouchers provided with Form 1040-ES (NR) if paying by check or money order. Print your name, address, and SSN or ITIN. If applying for an ITIN, write “ITIN TO BE REQUESTED.” Enter payment amount. Write “2020 Form 1040-ES(NR)” and the identifying number on the check. Do not staple payment to the voucher. Consider electronic payment methods for faster processing.

Step 15: Renew ITIN If Required

ITINs with middle digits 70-87 expired December 31, 2019. ITINs not used on a federal return in 2017, 2018, or 2019 also expired. Renew using Form W-7 before using on 2020 returns or payments.

Step 16: Maintain Records

Keep accurate payment records using the worksheet in the Form 1040-ES(NR) package: document dates, amounts, and confirmation numbers. Attach records to your 2020 Form 1040-NR. If you have changed your name and made payments under a former name, please attach a statement showing all costs and the identifying numbers used.

Step 17: Understand Penalties

Avoid the penalty if you owe less than $1,000 or have paid at least 90% of the 2020 tax or 100% of the 2019 tax, whichever is less. Higher-income taxpayers whose 2019 AGI exceeded $150,000 or $75,000 for married filing separately must pay 110% of the 2019 tax. If income changes significantly, recalculate the estimated tax and adjust the remaining payments accordingly. Consider using the annualized income installment method, as outlined in Form 2210 with Schedule AI, if you have seasonal income.

Important Restrictions

Nonresident aliens cannot file joint estimated payments if both spouses are nonresident aliens. Only claim credits and deductions related to effectively connected income. Include household employment taxes only if federal withholding applies or is necessary to avoid a penalty.

The household employment threshold is $2,200 in wages. Do not report state estimated tax payments on federal Form 1040-ES(NR).
